Legal Requirements & Eligibility

In Kazakhstan, the surrogacy process is governed by the Code of the Republic of Kazakhstan "On Marriage (Matrimony) and Family." To ensure the protection of all parties, Kazakh law sets clear criteria for who can participate in a surrogacy program.

Marital Status

Available to legally married heterosexual couples. Under current Kazakh law, the primary group eligible for surrogacy is married heterosexual couples.

  • International & Domestic: This applies to both citizens of Kazakhstan and foreign citizens.
  • Legal Standing: The marriage must be legally registered and recognized. 

Important Restrictions (Who is NOT Eligible)

It is important to note that Kazakh law currently excludes certain groups from surrogacy programs:

  • Single Men: Single fathers cannot currently access surrogacy in Kazakhstan.
  • Same-Sex Couples: Same-sex marriage is not recognized in Kazakhstan, and ART services for same-sex couples are legally prohibited.
  • Single Women (General Case):  The process for single women legally complex is unavailable.
